3. Client Responsibilities
Clients agree to:
Provide accurate information necessary to run campaigns
Ensure any leads uploaded or provided were gathered legally with proper consent
Comply with all advertising platform policies (Meta, Google, TikTok, etc.)
Maintain compliance with all applicable laws
Pay all service fees on time
Clients are solely responsible for the accuracy and legality of any data provided to NextLevelLeads.
4. Lead Generation & AI Follow-Up Services
NextLevelLeads may use automated systems and AI to:
Respond to leads
Send follow-up messages
Confirm appointments
Score and tag leads
Automate simple customer interactions
By using our Services, you consent to the use of automation as part of your deliverables.
We do not guarantee any specific number of leads, appointments, sales, or outcomes. All results vary based on market conditions, ad spend, offer quality, and other factors outside our control.
5. SMS Messaging & Compliance
a. Consent & Opt-In
Clients and leads who provide their phone number acknowledge and agree that:
They have opted in to receive SMS communications
They may receive appointment reminders, follow-up messages, and service-related updates
Message frequency varies based on engagement
b. Opt-Out
Users can unsubscribe anytime by replying STOP, UNSUBSCRIBE, or CANCEL.
c. Compliance
We comply with:
TCPA
CTIA Messaging Guidelines
CAN-SPAM (where applicable to SMS)
Clients are responsible for ensuring they have legally obtained consent for all phone numbers provided to us.
d. Fees
Message and data rates may apply based on the user’s carrier.
6. Data & Privacy
Your use of our Services is also governed by our Privacy Policy, which explains:

How AI tools process data
How SMS communication is handled
How cookies and tracking technologies function
By using our Services, you agree to the Privacy Policy.
7. Payments, Billing & Refunds
a. Payments
Clients agree to pay all fees associated with the Services they purchase.
Fees may include:

Ad spend budgets
Setup or onboarding fees
Additional service upgrades
b. Billing
Unless otherwise stated in writing:
Payments are billed automatically
Services may require prepayment
Ad spend is separate from service fees and is the client’s responsibility
c. Refund Policy
Due to the nature of digital marketing and service-based work, all sales are final and non-refundable unless otherwise specified in a contract or agreement.
We do not guarantee:
Lead quantity
Lead quality
Appointment rates
Sales results
ROI
You are paying for services rendered, not guaranteed outcomes.
8. Acceptable Use
Users agree not to:
Use our Services for illegal or fraudulent purposes
Upload harmful, defamatory, or infringing content
Attempt to copy, reverse engineer, or replicate our AI or internal systems
Attempt to access systems without authorization
Interfere with or disrupt service performance
Violations may result in service suspension or termination.
9. Disclaimers
We do not guarantee specific results from advertising or lead generation
All performance metrics depend on factors outside our control
We make no warranties regarding uninterrupted access, error-free functionality, or guaranteed outcomes
Any information provided by us (strategies, recommendations, scripts, etc.) is for general guidance only
10. Limitation of Liability
To the maximum extent permitted by law:
NextLevelLeads is not liable for any indirect, incidental, consequential, or punitive damages
Our total liability for any claim shall not exceed the amount paid for the Services in the 30 days preceding the claim
We are not responsible for losses due to platform bans, algorithm changes, ad performance fluctuations, or client misuse
Clients are responsible for ensuring their own compliance with industry regulations.
11. Termination
We may suspend or terminate Services if:
Payments are not made
A client violates these Terms
A client abuses the platform, messaging tools, or advertising accounts
A client engages in fraudulent, illegal, or harmful activities
Clients may terminate service according to the cancellation terms in their agreement.
12. Intellectual Property
All content created by NextLevelLeads—including but not limited to landing pages, ads, scripts, systems, automations, AI logic, templates, and branding—is owned by NextLevelLeads unless explicitly transferred in writing.
Clients receive a license to use deliverables only within the scope of their service agreement.
13. Changes to Terms
We may update or modify these Terms at any time.
Continued use of the Services constitutes acceptance of the updated Terms.
